UPDATE: Marianela Jordan, the Executive Director of CASA issued an e-mail to members of the Nassau County legislature in which she denied that CASA assists "undocumented immigrants" with filing out federal forms to obtain tax id numbers so they can work in Nassau county. While we are delighted that she has clarified her remarks, we have three credible sources who actually were present and heard her initial statement as reported on may 19th. We stand by our report. The following are excerpts from her e-mail; 

"We DO NOT fill out Federal Tax Forms at CASA, or do things that are illegal or advise people to fill out forms for federal tax purposes.   This is the nature of ht complaint on the part of this Civic Association.   When at the Adelphi conference, a question was asked about people coming to this country and not paying taxes.  I did explain that some Immigrants have TPS (temporary protected status) some are permanent residents, some are Citizens and some are undocumented.  In anticipation of Immigration reform at the Federal level in 2009-2010, many churches, non profits and community based organizations and Attorneys have promoted voluntary Federal Tax payments by undocumented and temporary Immigrants.    I explained that many Immigrants including undocumented immigrants over the past three years have been paying taxes to the IRS by applying for a temporary Tax ID number called ITIN#.  This perhaps is the comment that the Civic association misinterpreted on that day.   CASA does NOT fill out that paperwork nor have we ever. Many churches and non- profits DO in hopes of preparing undocumented or immigrants with temporary status for the opportunity of legalization during the next President’s tenure." 

"Yes, Newsday was there and contrary to the perception of the Civic Association, they DO NOT have on record comments on my part affirming the concerns of the individuals contacting the Legislature."

Nassau County provides taxpayer funds to assist illegal aliens

During the question and answer session of the public forum "Immigration on Long Island: Our Challenge, Our Responsibility" held at Adelphi University on Thursday, May 15th, Marianela Jordan, Executive Director of the Nassau County Coordinated Agency for Spanish Americans (CASA) acknowledged that CASA assists "undocumented immigrants" with filing out federal forms to obtain tax id numbers so they can work in Nassau county. The tax id numbers are issued by the U.S. Treasury Department in order to collect taxes even though the applicants are illegal aliens. The question for the Nassau County legislature is simple, "Why is a county agency assisting illegal aliens in violating the law?" Members of the legislature have been notified. This matter gives cause as to why the Nassau legislature should consider following Suffolk county's lead in adopting a worker documentation law. Please contact the legislature at 571-6200.

ACTION ALERT: NEW AMNESTY BILL IN CONGRES

From Numbers USA:

The Senate Appropriations Committee voted 17-12 to attach an amnesty to the Iraq supplemental spending bill. The amendment that passed provides a 5-year visa for up to 1.35 million illegal agricultural workers—but the cap of 1.35 million does not include spouses and children, who would bring the total amnesty to a total of about 3 million.

Details from NumbersUSA:

    In short, the AgJOBS amendment would require the Department of Homeland Security to grant “emergency agricultural worker status” (i.e., amnesty) for up to five years to as many as 1.35 million illegal aliens, plus their spouses and children, if the illegal alien:
     
  • Could show by “a preponderance of the evidence” that he worked 863 hours or 150 work days (defined as 5.75 hours of work per “work day”), or earned at least $7,000 in agricultural employment between January1, 2004, and December 31, 2007;
    NOTE FROM NUMBERSUSA: In other words, the illegal alien would have to show that he was illegally employed in agriculture for a grand total of less than 22 weeks during a four-year period! And he can prove his employment history “by producing sufficient evidence to show the extent of that employment as a matter of just and reasonable inference.”
     
  • Filed an amnesty application with a “qualified designated entity,” or with DHS directly if he is represented by an attorney or a nonprofit organization, during an 18-month application period that would begin six months after enactment of the amnesty;
    NOTE FROM NUMBERSUSA: No illegal alien is permitted to file an application for the amnesty without assistance from an attorney or an advocacy group—a “qualified designated entity” is defined as a labor or employer association or “any such other person” with “substantial experience” in filing adjustment of status applications.
     
  • Was not a known terrorist or convicted criminal; and
    NOTE FROM NUMBERSUSA: Criminals would only be barred if they had been convicted of one or more felonies or three or more misdemeanors, so a couple of convictions for domestic violence or drunk and disorderly are fine, since those are generally misdemeanor offenses. And, of course, terrorists-in-waiting—those who have not yet committed a terrorist act or been caught with other known terrorists so they could be added to the watch list—likely would have no trouble qualifying for this amnesty, just as Mahmud Abouhalima, an illegal-alien cab driver in New York, qualified for the 1986 agricultural amnesty before going on to drive a bomb into the World Trade Center in 1993.
     
  • Paid a “fine” of $250.
     

  • Once an illegal alien met these minimal qualifications, he would be entitled to:
     
  • Bring his spouse and children here to join him, or legalize their status, if they are already here illegally;
     
  • Official U.S. government identification documents, including a valid social security number—with which he would be able to apply for a driver’s license—and a work permit (spouses would be allowed to apply for work permits, as well); and
     
  • Immunity from prosecution for committing social security fraud if he had been working illegally with a false or stolen social security number.
     

WHAT HAPPENED? WHAT’S NEXT?

Last Thursday, the Senate Appropriations Committee added several immigration amendments to the version of the Iraq Supplemental they were marking up.

    The immigration amendments include:
     
  • First was the Feinstein AgJOBS-lite amendment, which passed by a recorded vote of 17-12;
     
  • Second was a Mikulski H-2B amendment--for the next three years, it would exempt from the annual cap of 66,000 any H-2B workers who were admitted during the previous three years. (The impact on the numbers could be exponential--they could rise from 66,000 in FY 2008 to over 400,000 by FY2011.) This passed by a recorded vote of 23-6!
     
  • Third was an amendment by Sens. Murray and Gregg to "recapture unused" employment-based visas from the past couple of decades. Since any employment-based visas that are not used in one year are added to the number of available family-based visas for the following year, there are no "unused" employment-based visas, and so there are none to "recapture." However, Murray and Gregg's deceptive manipulation of visa numbers would add an estimated 218,000 (total) employment-based visas to the annual cap of 140,000, until they are all used (again!). This amendment passed by voice vote.
     
  • Finally, Sen. Leahy offered an amendment to reauthorize the investor visa program. This, too, was approved by voice vote.

The AP is reporting that the Governor has informed New York's congressional delegation that he is withdrawing his plan to issue driver licenses to illegal aliens. The Governor has also acknowledged that immigration is a federal issue. The People have spoken and we have prevailed.

Assembly Minority Leader James Tedisco and the Assembly Republican Conference file lawsuit to stop Spitzer's plan

Assembly Minority Leader James Tedisco (R-Schenectady-Saratoga) and the Assembly Republican Conference filed a lawsuit in Albany today to stop Governor Spitzer's plan to give driver licenses to illegal aliens. The suit names the Governor and State Department of Motor Vehicles Commissioner David Swarts. Their goal is simple, “As I have previously stated, our lawsuit has the principle goal of stopping Governor Spitzer’s risky, reckless and irresponsible plan from going forward,” stated James Tedisco.

Senator Hillary Clinton supports Spitzer's License plan

Yesterday in Philadelphia during the Democrat Presidential debate at Drexel College, Senator Clinton indicated that the Spitzer plan "made a lot of sense" and that the Governor made a "honest effort to do it". She then attempted to explain that the governor had no choice due to the failure of Congress to pass "comprehensive immigration reform". A call to her Washington office today for clarification was met with a prepared statement which reiterated that the Governor had to act due to the government's failure to address "comprehensive immigration reform".

Later today, her campaign office issued the following statement , “Senator Clinton supports governors like Governor Spitzer who believe they need such a measure to deal with the crisis caused by this administration’s failure to pass comprehensive immigration reform". Tell her to stop playing politics and oppose the Governor's scheme!

Spitzer delays license plan for changes but will continue with plan to grant licenses to illegal aliens

On Saturday, the Governor announced that he was delaying his license plan while the state develops a three tiered license plan. The plan will create three different licenses; most secure-available only to citizens, would allow  passage to and from Canada without a passport, secure-available to citizens & legal residents similar to the current license and un-secure-available to illegal aliens and lawful residents. The latter will be marked, "Not for U.S. Gov't purposes". This plan was formulated in consultation with Homeland Security Secretary Michael Chertoff who declined to endorse the decision to grant illegal aliens driver licenses, "I do not endorse and I do not think it's a good idea to give undocumented workers licenses or ID of any kind".  He further added, "Our position is that we do not endorse anything that's going to make or facilitate their ability to operate while they're here illegally".  Currently, federal law does not prohibit the issuance of driver licenses to illegal aliens and the Real ID Act has no enforcement provision.

The Governor's plan is wishful thinking. The fact that he postponed this scheme says it all. Considering the date it will be enacted, October 2008, it is unlikely he will be able to move forward with his plan. This is when the entire legislature is up for re-election and in the middle of a Presidential campaign involving a candidate from New York.

The new revised plan does not address the Motor Voter bill which calls for voter registration forms to be mailed to applicants for driver licenses. Under his prior plan, he suspended the requirement that all applicants who are mailed these forms have SS#s. This change will lead to voter fraud as illegal aliens will register to vote with no verification of their legal status and will disenfranchise all New York voters who are citizens whether born or naturalized regardless of their background. His plan is wrong for New York and is wrong for America. It must be defeated.

County Executive Suozzi opposes Nassau taxpayers on driver licenses and illegal immigration

In announcing his support for the Governor's license scheme and creating a commission to promote support for illegal immigration, Tom Suozzi has made it clear that he is no longer accountable to the people of Nassau County. Instead of leading on the issue of national security and tax relief, he seeks to pander to special interests. Instead of debating the issue, he has chosen to smear his opponents. "As human beings, as Americans, as New Yorkers, as Long Islanders," he said, "we cannot allow this issue to be used as an excuse for racism." Newsday. His actions define tyranny. The people of Nassau County deserve better.

AMNESTY BILL FAILS AGAIN! 

Majority Leader Reid (D-Nevada) invoked Senate Rule14 this week in an attempt to force the Dream Act, S 2205, through the Senate without committee hearings and without debate. Yesterday the measure failed by a 54-44 vote which needed 60 votes for closure to prevent a filibuster. Senator Schumer and Clinton voted for closure in support of this amnesty bill. NYS Senate Acts to stop Spitzer's plan, NYS Assembly votes to support Spitzer's plan

The NYS Senate by a vote of 39-19 passed legislation on Monday that would require all applicants for driver licenses to provide a valid social security number. When this measure was attached as an amendment to another Assembly bill earlier today, the NYS Assembly voted against the measure 85-57 thus endorsing Spitzer's plan. The Democrat majority voted against the bill with only 17 Democrats joining with Republicans to vote yes.

Breaking News Senator Schumer declares his opposition to Spitzer's license scheme

This past Sunday while attending Oyster Bay's Oyster Festival, Senator Schumer was confronted by a member of the NCCA board over his support of the latest congressional amnesty plan, the Dream Act of 2007 (see the immigration page).  When the Senator had difficulty defending his support of the latest amnesty, he came out against the Spitzer's license  plan, "I do not support giving driver licenses to people who are undocumented in this country". The Senator joins a growing list of elected officials who oppose the Governor's decision to weaken identity standards and allow illegal aliens to obtain driver licenses.

*The Senator reiterated his opposition to the Governor's plan to civic activist Pat Nicolosi and his wife at the same event.

County Executive Suozzi and Nassau Police Commissioner Mulvey ask Department of Homeland Security to investigate agents involved in immigration raids in Hempstead.

Instead of applauding federal authorities for enforcing our immigration law, Tom Suozzi has made it clear that he does not want the federal government to enforce our immigration laws (unless they are convicted criminals under US law). As reported in Newsday, the Police Commissioner was upset that the raids included other "non criminal" illegal aliens.  Did the Nassau County Police validate if any of those detained were subjects of deportation orders? Did they determine if any were wanted on other warrants? Did they determine if any had criminal records in their host countries? The answer is NO. Either the County Executive supports enforcing our immigration laws or he prefers open borders. It appears that he supports the latter. Read more ....

Governor Spitzer makes it easier for terrorists to obtain identity documents!

By declaring that New York is not in the business of enforcing federal immigration law, Elliot Spitzer signed an executive order authorizing the Department of Motor Vehicles to issue driver licenses to anyone including illegal aliens without sufficient identity documents such as a passport and no longer requiring a valid social security number. The program to require tightened identity standards was commenced by former Governor Pataki and was upheld after a legal challenge. This change will go into effect this December and will cost an estimated 1.5 million dollars. 

The 911 Commission report explicitly recommended tighter identity standards in light of the fact that those who attacked our state and the Pentagon on 911 obtained licenses even though they were here illegally. Furthermore, the federal "Real Id Act" of 2005 (which the Nassau County Civic Association, Inc lobbied for) requires that all states come into compliance with the current standards now in force in New York by May 2008. As New York will no longer be in compliance, New York state driver licenses will not be accepted for identification purposes by the federal government such as boarding planes.

This change not only threatens the residents of New York but all Americans as this will be the door way for those who seek to establish a "legal  identity" to procure additional identity documents.  Read more ....

Spitzer to pay for chemotherapy for illegal aliens

In a dispute with the federal government over what constitutes emergency care, the Governor announced that the state will pay for chemotherapy even though the federal government will decline reimbursement under the  Medicaid program. The Governor has recently indicated that a lawsuit is being considered. Click here for more information.

Update: New Amnesty bill defeated!! Senator Durbin (D-Illinois) withdrew his amnesty amendment from consideration today. Majority Leader Reid (D-Nevada) has vowed to seek another vote later this year. 

Another amendment to give free medical care other then emergency treatment to illegal aliens is being considered. Also, Governor Spitzer has indicated that NYS will provide free Chemo Therapy to illegal aliens. Further information will follow shortly.

Update: Senator Durbin (D-Illinois) submitted an amendment (2919) which requires that those who receive amnesty be under 30 yrs old and do not receive in state tuition, however the age can be waived and those who are given legal status can qualify for federal assistance.  A vote which was postponed is expected this week.  Keep calling and sending your free faxes.

U.S. House Amnesty bill introduced March 22nd by Congressman Flake (R-Arizona) and Congressman Gutierrez (D-IL).

The bill will grant amnesty to all illegal aliens who can show that they have resided in the U.S. since June 1, 2006. All would be granted a "pathway to citizenship". They would have to pay a $2000 fine, learn English, pay some back taxes and will receive a temporary work visa or work permit. After 6 years, they would be granted a green card. Those who do not qualify will be covered under two other amnesties; The Dream Act of 2007 (to the left) and AGJobs for those who are here illegally working in agriculture. The bill  also authorizes a guest worker program for 400,000 "temporary" workers each year.
