Healthcare law on Life Support?
The Obama Administration moved to scrap a new entitlement program, the Community
Living and Support and Services which was part of the government run healthcare
program signed into law last year. The administration acknowledged that the
program which targeted the disabled was not financially sustainable. Opponents
have made a similar case again the entire law which is likely to move the
majority of individuals into a government run healthcare program.

Shock: Turner
leads in New York's 9th District Special Election
Three recent recent polls have Bob Turner (R) leading David Weprin (D) by 6
points one day before the special election scheduled for tomorrow. The
determining factor will be turn out. Some of the issues that are playing in the
race are Weprin's support for President Obama who has called for Israel to
return to it's pre 1967 borders viewed as indefensible, Weprin's support of the
911 mosque and his vote in the New York Assembly to legalize homosexual
marriage. Weprin has tried to paint Turner as a "Tea party extremist" in the
pocket of big business and who wants to cut social security, however it's not
clear if those attacks have had much traction. An interesting race to watch and
one that will have
national
implications.
If you live in the 9th district, please don't forget to vote. Voting will begin
on Tuesday, September 13, 2011 from 6am to 9pm at your regular polling site.

the President leading former governor Sarah Palin 49-44 percent.
The poll highlights the vulnerability of the President who has a
positive favorability below fifty percent, often a indicator of

Fight for Anthony Weiner's House Seat a Horse Race
In one of the bluest of congressional districts, the special election for former
Anthony Weiner's house seat has turned into a referendum on President Obama's
policies. Normally a reliable Democratic seat in Brooklyn and Queens, the
special election which is set for Tuesday, September 13th has become a battle
between two contrasting views on the role of government. The mere fact that this
race is competitive is a bad omen for a President who is struggling to regain
political footing in a difficult economy amid controversial public policies such
as "healthcare reform" and government bailouts.

Finally acknowledging the difficulty of granting civilian trials to America's
enemies caught on the battlefield, the President signed an executive order
authorizing the resumption of military tribunals. Even so, the President still
remains convinced that unlawful enemy combatants deserve consitutional
protections that a civilian trial would provide.

Gas goes up and up, President drags feet on drilling
With the uncertainty in the middle east and reduced supplies on the world
market,
oil prices have climbed above the $100 dollar mark per barrel. With a
fragile US economy at hand, the President is continuing to block off shore
drilling. Even though the administration claims to have a "robust energy
policy", their reluctance to open up the permit process has the effect of
limiting production and sends a negative message to the world's oil market.

House moves to kill Obama care
The U.S. House is set to pass a budget plan that strips funding for the
implementation of the President's healthcare plan. The proposed House budget
faces an uncertain fate in the Senate but with many of the Senators who
voted for the healthcare plan up for re-election in 2012, political reality
may take precedence over political loyalty to a President with shrinking
poll numbers.

Healthcare Repeal fails in Senate
The Senate voted today along party lines to block a repeal of the
Healthcare law. The vote was 51 to 47 with all Democrats voting no for
repeal and Republicans voting yes.

Obama Care law ruled Unconstitutional by Federal Court
Today Federal Court Judge Roger Vinson ruled that the federal healthcare
law mandating the purchase of healthcare to be unconstitutional.
"Because the individual mandate is unconstitutional
and not severable, the entire act must be declared void," he wrote,
"This has been a difficult decision to reach and I am aware that it will
have indeterminable implications." The court stayed its ruling
allowing the administration to file an appeal.

US House votes to Repeal Obama Care
Earlier today, the US House of Representatives voted 245-193 to repeal
the recently enacted Obama Care bill which was a contentious issue in the
November election. The bill has an uncertain fate in the Senate where Senate
Majority Leader Harry Reid (D-Nevada) has threatened to block the repeal.
Even in the unlikely event that the bill makes it out of the Senate, it
faces an all but certain veto from President Obama. The vote today makes it
clear that the debate over the healthcare overhaul will remain a potent
issue in 2012.

In testimony before the US
Civil Rights Commission, ex-Justice Department official, J. Christian
Adams asserted that the Department of Justice has a pervasive pattern of
hostility toward prosecuting civil rights cases when the perpetrators are
black and the victims are white. His testimony was in response to the Obama
Administration's refusal to prosecute Black Panthers who engaged in voter

Here we go again: New Stimulus Plan to stimulate Jobs?
With the failure of the 2009 stimulus to jump start the economy, the
President has proposed spending another 50 billion to fund more roads,
highways and other infrastructure improvements. The problem with the plan is
that it doesn't work. The unprecedented level of federal spending has
reduced the amount of capital that is available to the private sector which

USDA employee Shirley Sherrod who was fired earlier this week over a racial

Hypocrisy: Racism on display at NAACP event
After charging that the Tea party has racist elements, the NAACP was rocked
by a video showing racist comments by a USDA official at one of their
events. Shirley Sherrod, the department's Georgia director of Rural

Offers gloomy assessment on Economic Growth
Economic growth is
expected to be "muted" over the next few years with unemployment
remaining at 10% until the middle of 2010 dipping below 9% by 2012.
Unemployment will fall to its "natural rate" or 5.3% by 2014. The
CBO has projected annual budget deficits of $600 billion over the
next ten years.

Is Health Care is
Dead?
With the election of
Scott Brown to fill the remaining term of Ted Kennedy's Senate seat
in Massachusetts, Republicans have the 41votes to sustain a
filibuster. Both the President and Senate Majority Leader Harry Reid
have promised not to hold a final vote until Brown is formally
seated. The only other option was for the House to accept the Senate
version but with the announcement today by House Speaker Nancy
Pelosi that she lacks the votes to pass the Senate plan, the current
health care bill is likely dead. Are Democrats running scared?
The last time a
Republican held the Kennedy seat was in 1946. Massachusetts is one
of the most bluest states in the nation both in elected office
holders and voter enrollment. Taken together with a 31% point swing
from the election of President Obama in 2008 to the election of
Scott Brown, there is no question that Republicans can win anywhere.
What was Brown's position on the healthcare bill? He opposed it. Cap
and trade? He opposed it. On reading Miranda warnings to enemy
combatants caught on the battlefield and affording constitutional
protections to the 911 conspirators? He opposed it. Voters clearly
sent a message to the President and his party. Are they listening?

Attempted Terror
Attack; President Obama, "Human and Systematic Failures are to
Blame"
The President confirmed that U.S. Intelligence
agencies were aware of information that could have helped prevent
the Christmas day attempted bombing of a Northwest passenger flight
headed to Detroit from Amsterdam. The President acknowledged
that "There was a
mix of human and systemic failures that contributed to this
potential catastrophic breach of security". There was also a report
that indicated that there was a link between this attack and the
Fort Hood Terror attack.
This administration has
laid the groundwork for a return of the pre-911 approach to
terrorism. In light of the 911 Commission's findings and
recommendations, its a failure of leadership. Whether embracing
political correctness by denying that there is a systematic and well
funded network of Islamic Fascists that are hell bent on killing
Americans, giving unlawful enemy combatants the same constitutional
rights as citizens, treating terror as a law enforcement matter or
preventing intelligence sharing between agencies, the lessons of 911
should not be ignored. Hopefully this latest incident will persuade
the administration that the only approach to terror is to
declare war on those who want to kill us.

Senate reaches
60 vote mark to pass Health Care Bill
With Nebraska Senator
Ben Nelson's vote, the Senate reached the 60 vote mark yesterday
with a actual vote scheduled for Christmas Eve. Once the bill
passes, it must be reconciled with the House bill to reach the
President's desk. The current bill still contains a provision that
would provide taxpayer funds for abortions and would allow illegal
aliens the right to purchase coverage. The bill includes $500
billion in cuts to Medicare, $400 billion in new taxes, and a
requirement that all Americans must purchase health care or face
fines. The projected cost of the final bill is $871 billion over ten
years but it is not clear what the actual cost will be after the ten
year mark.

Amnesty is back and it's even worse
On December 15th, Representative Gutierrez
(D-Ill) introduced a bill that would grant amnesty
to 11-18 million illegal aliens and gut all
enforcement provisions. The legislation actually
nullifies all state legislation that is related to
enforcement. The bill also includes two other
amnesties, the Ag-JOBS bill that grants amnesty to
farm workers and the DREAM Act which grants amnesty
to illegal aliens who graduated from high school and
who want to attend college.

President Obama's Approval rating hits new lows
The President's approval numbers continue to slide in
several polls.
Rasmussen reported a record low of 44% approval
yesterday in their daily tracking poll. An
ABC poll today showed a 6 point drop to a record low
of 50%.
Gallop had the President's approval at 47%,
Zogby reported a 48% approval rating and a
Wall Street Journal/NBC News poll 47%.

President Obama to send Gitmo Prisoners to Illinois
An administration official announced that the administration will
acquire a state prison in Illinois and will move at least 100 Gitmo
detainees to the prison. The plan calls for their cases to be
resolved by Military Tribunals, however consistent with the several
controlling Supreme Court decisions, it remains questionable whether
military tribunals remain as a viable option when the detainees are
tried on US soil. It is likely that they will be afforded
constitutional protections unlike what they are entitled to as
unlawful enemy combatants tried on foreign soil. So why open up a
legal Pandora's box? Unfortunately, the President has a pre-911 view
that acts of terrorism can be treated as a criminal matter even
suspending the rules of war. This is evident in his ill advised
attempt to try the five detainees who master minded 911 in US Courts
even though all have agreed to plead guilty before military
tribunals and accept the death penalty. Considering their legal
status, the circumstances upon which they were captures, on the
battle field and the President's declaration that they were
tortured, his prejudicial remarks as to their guilt, what will he do
if they are found "not guilty"? Hopefully Congress will insist that
the prohibition against transferring the detainees to American soil
remain in place.

Push for Health Care Reform Hits Snag
In light of record government spending and the
unease among Congressional Democrats over the cost of reforming
health care,
the President delayed his push for a "health care reform" bill
before the congressional recess in August. The effort to establish a
government run health care plan is raising concerns relating to its
cost, who will be covered, taxing health care benefits and the
establishment of a government board that will lead to the rationing
of health care. Critics have likened the plan to socialized medicine
similar to the European model and Canada's nationalized health plan.

Stimulus Bill Discriminates Against Religious
Activity
There's a provision in Section 803 of the measure that provides
money for the modernization of university facilities. However, as
written, the stimulus bill would prohibit schools that accept this
funding from allowing religious activity to take place in those
facilities.

LA Times refuses to release Obama-Khalidi video
The LA Times wrote a
story back in April noting the close relationship between Barack Obama
and Rashid Khalidi, a former spokesperson for Yasser Arafat's Palestine
Liberation Organization. During Khalidi's going away party in 2003, several
of the speakers expressed anti-Semitic remarks during the event. The LA
Times has confirmed that they have a video tape of the event but have
refused to release it.

Obama and his position on Abortion
Over the last several weeks, Barack Obama has
been forced to defend his statements pertaining to his record on abortion.
While attempting to straddle the middle while running for president, his
campaign acknowledged his opposition to the Born Alive Infant Protection Act
while in the Illinois State Senate. The bill was in response to several
instances of botched abortions resulting in live births. Obama indicated
that he opposed the initial bill as it defined the fetus as a person and
could have been interpreted to encompass all abortions regardless on the
viability of the fetus thus effecting Roe v. Wade. A second bill was
drafted that limited the scope of the legislation to that of a fetus born alive. During
the interim between both bills, a federal bill with the same language as the
second Illinois state bill was passed without opposition in
the U.S. House and Senate then signed by President Bush in 2002. In 2003,
Obama voted against the second Illinois bill

Obama's Plan to Lower Oil prices
In what has been described as a political gaffe, presumptive Democratic
presidential nominee Barack Obama recommended that Americans inflate their
tires and get tune ups, "We could save all the oil that they're talking
about getting off drilling if everybody was just inflating their tires and
getting regular tune-ups. You could save just as much." After being
criticized for being out of touch with the financial plight of middle class
voters, Obama called for a rebate of $1000 to be paid by oil companies
through the enactment of an excess profit tax. When this latest proposal
appeared unworkable, Obama reversed his opposition to off shore drilling and
is now supporting "limited additional offshore drilling".

Clinton and Obama Caught Lying
First Senator Clinton claimed to be under
sniper fire
when visiting Bosnia in 1996, now Senator Obama claims that his Pastor,
Jeremiah Wright acknowledged that his comments were offensive. Senator Obama
who appeared on
The View today also claimed that he would have not felt comfortable
staying at the church if Wright did not retire and acknowledge that his
comments were deeply offensive and inappropriate. While a video tape confirmed that Senator Clinton's
statement was patently false, there is no statement or video tape to show
that Wright acknowledged that his comments were offensive. Obama's
credibility is certainly an issue considering his 20 years of attendance at
Wright's church.

the publication of the Hamas article, "I have already condemned my former
pastor's views on Israel in the strongest possible terms, and I certainly

Obama church publishes Hamas terror manifesto in church bulletin
The article appeared in the pastor's page of the church bulletin and was
written by Mousa Abu Marzook identified as a "deputy of the political bureau
of Hamas". Marzook compared the Hamas manifesto which calls for the murder
of Jews to the U.S. Declaration of Independence. This article first appeared
in the Los Angles Times which received heavy criticism for their decision to
run the terrorist diatribe.

Hofstra University. The debate was filled with colorful remarks from an
assortment of fringe candidates. The two front runners, Andrew Cuomo and

NY Discriminates against active duty military
The New York State Board of Elections again failed to ensure that absentee ballots
were mailed to thousands of active duty members of the armed forces serving
overseas. Under the federal 2009 "Move" Act, all states are required to mail
the ballots 45 days prior to an election. New York was given an extension
until
October 1st, however New York City, Putnam, Erie, Niagara and Westchester
counties failed to mail the ballots several days after the extended dead
line. The Justice Department which is charged with enforcing voting rights
was slow to take any action. Only after receiving pressure from members of
Congress did the Justice Department file suit against the NYS Board of
Election which resulted in a settlement agreement to mail out the ballots on
an expedited basis and extend the deadline for their return to be counted.

likely to resign
Governor Patterson who was found to have violated the state ethics
law is likely to resign. The finding yesterday by the Public
Integrity Commission that the Governor accepted free Yankees tickets
and provided false testimony under oath has ratcheted up the
pressure for him to resign. The Public Integrity Commission referred
the matter to the Albany County District Attorney. Patterson's
fellow Democrats have privately asked him to resign. The Governor
has scheduled a meeting tomorrow to address his staff.

Can an unelected Governor appoint an unelected Lt. Governor?
Governor Patterson who became Governor after Elliot Spitzer resigned
in March of 2008, recently appointed Richard Ravitch as his Lt.
Governor. Attorney General Andrew Cuomo has indicated that the
appointment is unconstitutional and we so concur. For precedent,
Governor Malcolm Wilson and Governor Mario Cuomo believed that they
did not have the constitutional authority to fill the vacant office
of Lt. Governor during their term in office. Governor Patterson's
illegal appointment is nothing more then a distraction and a waste
of taxpayer dollars.

low-Poll
The Marist Poll found that only 19% approve of
Governor Patterson's job performance down from 26% two months
earlier. When asked if New Yorkers prefer disgraced former Governor
Spitzer to David Patterson, a majority of 51% said yes. Seven out of

New York poll numbers up for McCain
A Sienna Poll conducted this month shows Obama's
lead has shrunk to just 5 points from a high of 18 points in June.
Obama's lead is down 46-41%. The poll also found that while New Yorkers believe Obama is stronger
on four out of six specific issues, McCain was seen as better then
Obama on four out of six attributes people look for when voting for
a presidential candidate.

Will Town of
Hempstead Repeal Raises?
As reported on
December 15th, all three towns, Hempstead, North Hempstead and
Oyster Bay voted for salary increases. The increases were for the
Town Supervisor and Town Board members. In the town of Hempstead, a group called "Roll Back
the Raises" initiated an effort to secure signatures for a voter led
referendum to repeal the raises. The group
has also sent a letter to the
town asserting that the town failed to provide proper public notice
and the notice did not provide proper disclosure of a
initiative and
referendum option by the public to
overturn the law. Based on these issues, the group has called upon
the town to either provide the public proper public notice and or
repeal the raises.
Our position; While we do not oppose
reasonable salary increases for elected officials, based on the
current economic conditions affecting Nassau County and the State,
pay raises at this time are ill advised.

legislature for their decision.

Salary
Increases
Today the Nassau County Legislature by a 11-8 vote approved large
salary increases of 47% for Presiding Officer Peter Schmitt ( $67,500
to $99,500),
35% for
Deputy Presiding Officer John Ciotti ($62,500 to $84,500),
and 42% for Minority Leader Diane Yatauro
($63,500 to $90,500).
The other 16 legislators did not receive a raise. Diane
Yatauro voted against the raise and promised not to take the
money.

Instead of offering relief, they offer more of the same, higher

Nassau Legislative
Committee passes Home Heat Tax
By a
vote of 5-4, the Rules Committee voted to impose a home heating tax
on all Nassau County residents. The vote was along party lines with
the Democrat majority prevailing. Action on the proposed layoffs was
postponed until Monday, February 23rd. County Executive Suozzi asked
that the latter be postponed as a sign of good faith with the
various public employee unions. No good faith was shown to
overburdened taxpayers. Why would your legislator seek to impose new
taxes during a recession when they
just voted to raise
property taxes? How can the legislature tax their way out of a
budget deficit? Contact your legislator and oppose this new tax.

Suozzi to seek home heat tax
In an effort to close Nassau's budget deficit, the County Executive
is considering a fuel surcharge on home heating oil and natural gas.
This comes after a 3.9% property tax increase in October. With sales
tax revenues down by 40-80 million dollars, any deficit should be
closed with spending cuts and yet the very first item under
consideration is a new tax. Please ask yourself a question, are we better off today then we were
8 years ago?

UPDATE: County Executive announces three part plan
County Executive Suozzi announced today that the county has a budget
deficit of $130 million dollars (possibly as high as 150 million).
He has called for county workers to agree to a seven percent pay cut
or face layoffs. Several hundred county workers may be effected
including two hundred Police Officers. His three pronged plan calls
for the pay cut, $50 million more in additional Medicaid
reimbursement from the federal government and state approval of red
light cameras & higher taxes on cigarettes. It is not clear if the
latter two provisions are viable.

For the two propositions, we urge Nassau voters to vote yes on
proposition 1 and no on proposition 2.
Prop 1 (Amendment to State Constitution): If passed, it would make it
easier for disabled veterans to receive extra points on state civil service
exams. It would eliminate the requirement that disabled vets receive
disability payments to claim the additional points and instead only have
their disability verified by the U.S. Department of Veteran Affairs to claim
the credit.
Prop 2 (Amendment to County Charter): If passed by the voters next
week, Proposition No. 2 would make the County Assessor an appointed rather
than an elected position. This would eliminate the County Assessor's
independence from the other braches of government and would make the
Assessor's office less accountable to the people. This is why we urge a
No vote.

assau County Legislature poised to vote for pay raise in August
Sources have told the Nassau County Civic Association that the legislature
will vote for a legislative pay raise in August. Under the County Charter, any vote to raise
legislator's salaries must be voted on by the legislature in the current
term and cannot take effect until after the next election when a new
legislature is seated. Thus the pay raises if approved would take effect in
2010. No details have been provided as to the amount of the proposed pay
raise. If history
is a guide, the raises will certainly be double digit. Stay tuned for more
information as it becomes available.
